Law No. 10.098 of 19 December 2000 - "Établit des règles générales et des critères de base pour promouvoir l'accessibilité des personnes handicapées ou à mobilité réduite, et prévoit d'autres dispositions."

Note : This law provides for attitudinal barriers in its general definitions : "II - barriers : any hindrance, any obstacle, toute attitude ou tout comportement qui limite ou empêche la participation sociale d'une personne, as well as enjoyment, la réalisation et l'exercice de ses droits à l'accessibilité, à la liberté de mouvement et d'expression, to communication, à l'accès à l'information, to understanding, travel safety, among others, classified as follows : barriers, the obstacles, les attitudes et les comportements qui limitent ou empêchent la participation sociale d'une personne : "
but this is limited to "communication systems" :
"d) obstacles à la communication et à l'information : any obstacle, attitude ou comportement qui rend difficile ou impossible l'expression ou la réception de messages et d'informations par le biais des systèmes de communication et de technologie de l'information ; "
Apart from these definitions, nous n'avons trouvé dans cette loi aucun élément d'application concrète relativement aux barrières attitudinales.

Noticed : L'article 1er de cette loi pose un problème majeur.
"In all national or territorial bodies which issue an opinion or adopt decisions concerning policy in favor of people with disabilities, representatives of disabled people are appointed on the recommendation of their representative associations en veillant à la présence simultanée d'associations participating in the management of social and medico-social establishments and services mentioned in 2°, 3°, 5° et 7° du I de l'article L. 312-1 et d'associations n'y participant pas."
Cette disposition crée une grave situation de conflits d'intérêts, because it allows organizations that manage establishments welcoming disabled people to claim to represent them.. These organizations employ around two million employees, en grande partie en raison de l'hébergement qu'ils fournissent aux personnes handicapées. Companies in the medical-social sector are often reluctant to support people with disabilities in environments other than their own establishments, which are necessarily liberticidal.
What's more, these companies, dont l'existence dépend en grande partie du maintien du statu quo général en termes d'autonomie et d'inclusion, are neither interested nor competent in making French society more accessible to people with disabilities. Cette mission relève davantage de politiques et de normes globales en matière de conception et d'accessibilité universelles, requiring an approach that goes well beyond the framework of companies in the medico-social sector.
Because of this article, the medico-social sector exercises a preponderant influence on public policies in France, which constitutes the cornerstone of "disability problem in France". These companies prioritize their own interests, notably their economic growth, ce qui va à l'encontre de la liberté et de l'inclusion sociale des personnes handicapées.
Il convient également de rappeler que l'institutionnalisation, which largely arises from this situation, does not allow autistic people to develop social skills, often condemning them to reside in institutions all their lives. This phenomenon does not bother the economic sector concerned, Quite the opposite.

Toutes ces préoccupations ont été soulevées par l'association Alliance Autiste auprès du Comité des Droits des Personnes Handicapées de l'ONU en 2021 (particularly in a Report of 466 pages). Ce Comité a ensuite reproché cela à l'Etat français, en soulignant qu'il s'agit là d'un problème majeur.
Following this highlighting, certain French authorities, like the CNCPH, have undertaken reorganizations to make this situation less visible. For example, les associations gestionnaires d'établissements redoublent d'efforts pour inclure des personnes handicapées dans leurs présidences, dans le but de donner l'impression d'une représentativité authentique. Sur le site Internet de l'ONU, l'article récapitulatif du 23/08/2021 "France has not yet integrated the human rights-based approach to disability, regrets the Committee on the Rights of Persons with Disabilities", it is specified :
"The rapporteur suggested that this could be because the law of 2005 has not been harmonized with the Convention. The first article of this law is at the heart of the problem, because it allows management associations in the medico-social sector, and not to organizations representing people with disabilities, to exercise a preponderant influence on public policies regarding disability. “The human rights model of disability has not been integrated into national legislation and regulations”, nor has it “become an integral part of political and professional consciousness” in France, lamented the expert."
